TGI Healthcare provides access to clinical consultations and other medical and care-related services through its mobile application — TGI Tele Medicare App — and website https://tgihealthcare.in, using secure video conferencing and online service booking features.

The following Terms and Conditions govern all transactions related to our services, including but not limited to online appointment booking, payments, refunds, and all other transactions made via the app, website, or any authorized third-party platforms.

The services listed on the app and website do not constitute a recommendation or invitation to avail of any service. They are offered as optional tools to help users connect with healthcare professionals.

Tele-consultations provided via the TGI Tele Medicare platform are not a substitute for in-person medical consultations. In case of emergencies or conditions requiring physical examination, users are advised to seek direct medical care.

TGI Healthcare urges all users to independently assess the accuracy, usefulness, and suitability of the services before relying on them for any medical decision.

By using the app or website, you agree to abide by these terms and confirm your understanding of the limitations of telemedicine services.

This Notice sets out the manner in which we collect, store, use, process, disclose, and/or transfer your personal data, including sensitive personal data or information (as defined under applicable Indian laws), when you access or use our digital healthcare services (“Services”), including but not limited to:

  • Downloading and using our mobile application(s), such as the TGI Healthcare app or any other application linking to this Privacy Notice;

  • Participating in any events or activities conducted by us.

This Privacy Notice applies to all users of the TGI Healthcare platform. How do we secure your personal data? We implement reasonable security practices and procedures as required under the IT Rules, 2011, including organizational and technical safeguards.   • Offer Wall Integration: Our application(s) may feature a third-party hosted “offer wall,” which allows third-party advertisers to provide users with virtual currency, gifts, or other items in exchange for completing an advertisement offer.   1. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We retain your information only as long as necessary to fulfil the purposes outlined in this privacy notice, or as required by law.

We retain personal information only for such duration as is necessary to achieve the purpose for which it was collected, in accordance with the principle of purpose limitation as set out under the Digital Personal Data Protection Act, 2023 and other applicable laws.

Unless a longer retention period is mandated or permitted under applicable laws (including tax, regulatory, contractual, or health-related reporting obligations), we will not retain your personal information for more than twelve (12) months following the termination or deactivation of your account.

When we no longer have an ongoing legitimate business purpose, legal obligation, or valid consent to process your personal information: (1) We will delete or anonymize such information within a reasonable period; or (2) Where immediate deletion is not possible due to technical constraints or data being stored in system backups, we will securely store and isolate such personal information from any further processing until deletion is possible.

You, as a Data Principal, have the right to request erasure of your personal data once the specified purpose has been fulfilled or consent is withdrawn, subject to applicable retention obligations imposed by law or contractual necessity.

While we are committed to complying with the Reasonable Security Practices outlined in Rule 8 of the IT Rules, 2011 — including adopting security standards such as ISO/IEC 27001 (where applicable) — we disclaim liability for security breaches beyond our reasonable control.

Right to Correction and Erasure: You may request correction, completion, or updating of your personal data, or erasure of such data if it is no longer necessary for the stated purpose or if consent has been withdrawn.

Right to Grievance Redressal: You have the right to register a grievance regarding the processing of your personal data or the exercise of your rights. Details of our grievance officer are provided in the section titled “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?”.

Right to Nominate: You may nominate another individual to exercise your rights under the DPDPA, in the event of your incapacity or death.

Withdrawing your consent: If we rely on your consent (express or implied) to process your personal information, you have the right to withdraw that consent at any time. You can withdraw your consent by contacting us using the details provided in the section titled “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?”.

Please note that the withdrawal of consent shall not affect the lawfulness of processing carried out before such withdrawal. Additionally, if permitted under applicable law, we may continue processing your personal information based on lawful grounds other than consent.

Opting out of marketing and promotional communications: You may unsubscribe from our marketing and promotional communications at any time by clicking the “unsubscribe” link provided in our emails, replying with “STOP” or “UNSUBSCRIBE” to SMS messages, or by contacting us using the details provided in the section titled “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?”. Upon opting out, you will be removed from our marketing mailing lists.   1. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers, certain mobile operating systems, and some mobile applications include a Do-Not-Track (“DNT”) feature or setting that you may activate to express your privacy preference—specifically, a request that your online browsing activities not be monitored and collected. At this time, there is no uniform standard for recognizing and implementing DNT signals. Consequently, we do not currently respond to DNT browser signals or any other automatic mechanism that communicates your preference not to be tracked online.

If a standard for online tracking is adopted in the future that we are required to comply with, we will implement such standard and update this Privacy Notice accordingly to inform you of the changes.

Notwithstanding the above, we continue to process your personal data only in accordance with applicable Indian data protection laws, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023.   1. DO USERS OUTSIDE INDIA HAVE SPECIFIC PRIVACY RIGHTS?

In Short: TGI Healthcare services are primarily intended for users located in India, and some services may not be available to users outside India.

  1. HEALTH INFORMATION COLLECTION AND CONSENT

TGI Healthcare processes health-related information including symptoms, diagnostic results, prescriptions, and medical history solely for the purpose of enabling teleconsultation, diagnostics, and related services.

By using TGI Healthcare Services, you expressly consent to the collection, storage, use, and sharing of such sensitive personal data with licensed medical practitioners, diagnostic laboratories, pharmacies, or healthcare professionals, strictly as required to deliver the Services.

All medical consultations and diagnostic services are provided in accordance with the applicable provisions of the Telemedicine Practice Guidelines, 2020, and the Digital Personal Data Protection Act, 2023.

  1. THIRD-PARTY AND FRANCHISEE DATA SHARING

TGI Healthcare may share your personal information with authorised franchise partners, diagnostic centres, and pharmacies to facilitate bookings, consultations, sample collections, report generation, or medication delivery.

Such third parties act as data processors and are contractually bound to comply with applicable data protection laws and to use your personal information solely for the provision of services on behalf of TGI Healthcare.

All franchisees operating under the TGI Healthcare brand are required to adhere to TGI Healthcare data protection policies and applicable legal standards.

  1. USE OF AUDIO, VIDEO, AND IMAGE RECORDINGS

When you use teleconsultation or self-test services through the TGI Healthcare platform, we may record video calls, test kit images, or audio interactions for purposes including diagnostic analysis, audit, legal compliance, or service quality assurance.

All recordings are encrypted and stored securely. Access is strictly limited to authorised personnel and retained only for as long as necessary to fulfil the stated purpose or as mandated by law.

  1. DATA BREACH NOTIFICATION

In the event of any data breach that is likely to result in harm to you, TGI Healthcare shall notify you promptly and inform the Data Protection Board of India in accordance with applicable law. TGI Healthcare will take all reasonable steps to mitigate the impact of such breaches and prevent recurrence.

  1. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.
